So many people do not seem to understand copyright laws. Australian copyright laws are covered by most international countries. There is no actual need to display a copyright logo on your pieces of art for it to be covered by copyright laws. Material is protected automatically as soon as it is recorded.

Still images such as photographs, drawings, maps and plans (referred to in the Act as "artistic works") are protected by copyright. Reproduction in a material form or in a different medium needs copyright permission. (2.2a) Transmitting electronically and making available online also needs permission. (2.2a)
It is an infringement of copyright if you are using a whole or important part of a work. There is no specific proportion or percentage, the quality of the part used is more important than its quantity.
Use of photographs:
You can not copy a photo that is over 50 years old from any source without permission. Copyrights last for 50 years from the death of the artist. (3.4a)
You can use a photo as a source of information for a painting or drawing but you MUST reference the work and in some cases if an important part of a photographer's composition is reproduced you will need to ask for permission. (3.4c)
This is subject to change as there are varying levels of copyright, so it is best to always ask the photographer's permission first.
Also a thing to remember: COPYRIGHT IS A FORM OF INTELLECTUAL PROPERTY.
I may seem pedantic and an ogre to some, but this is a form of my income. You would not like it if someone used your artwork on a tea-towel and sold a million of them for $1 a pop. Same principle.
Copyright is also used to encourage and reward the creation of new works. I enjoy making art and displaying it to others for their enjoyment, but I do not like seeing my work displayed on other people's websites as their own work. There are so many new ideas out there, it really is not necessary to steal others.
Ideas are free. Artwork is not.
Have a bit of respect and courtesy.

so many people seem to forget that about photographs and yes they are finished works and it is not appreciated when they are taken for use by another and especially without permission
